General Information
These general terms and conditions apply to purchases in the online store www.saman-shop.cz, operated by Matěj Čistecký, ID: 02778548, registered office at Nová Pasečnice 19, 34401 Pasečnice, and place of business at Náměstí míru 142, Domažlice 344 01. The trade license was issued by the Municipal Office Domažlice, Trade Licensing Department, regulating the relationship between the Buyer and the Seller in the area of sale of goods between Matěj Čistecký, ID: 02778548, registered office at Nová Pasečnice 19, 34401 Pasečnice (hereinafter referred to as the “Seller”) and his business partners (hereinafter referred to as the “Buyer”).
All contractual relationships are concluded in accordance with the laws of the Czech Republic. By submitting an order, the Buyer confirms that they have read these terms and conditions, which form an integral part of the ordering process, delivery times, prices and payments, warranty, and complaints procedure, and that they agree with them. The Buyer is duly informed about these terms and conditions prior to placing the order and has the opportunity to read them. The Seller is Matěj Čistecký, ID:02778548, registered office at Nová Pasečnice 19, 34401 Pasečnice, and place of business at Náměstí míru 142, Domažlice 344 01. The Buyer is a consumer or an entrepreneur. The consumer provides the Seller only with the contact details necessary for processing the order or details to be listed on the purchase documents. Legal relations between the Seller and the consumer not expressly regulated by these GTC are governed by Act No. 40/1964 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection, both as amended, as well as related regulations. The entrepreneur in this case means a person conducting business based on a trade license (a tradesperson registered in the Trade Register). Legal relations between the Seller and the Buyer who is an entrepreneur not expressly regulated by these GTC or the Contract are governed by Act No. 513/1991 Coll., the Commercial Code, as amended, as well as related regulations. An individual contract between the Seller and the Buyer takes precedence over these terms and conditions. It is a purchase contract under the Civil Code, provided that the contracting parties are a consumer on one side and a supplier, i.e. the Seller, on the other.
GDPR Law
The European GDPR regulation requires every company to ensure the protection of personal data. All handling of the Buyers’ personal data is governed by Act No. 101/2000 Coll., on the Protection of Personal Data, as amended, and other legal regulations valid in the Czech Republic. A Buyer placing an order agrees with further processing of their personal data for business purposes of the operator of this e-shop. Providing personal data is voluntary, and the Buyer has the right to access the data and the protection of rights guaranteed by law. This consent may be revoked in writing. Personal data will be fully secured against misuse. Data obtained based on a concluded purchase contract or browsing the operator’s website will be stored and not shared with third-party applications. The Seller and thus also the data controller may use the data to offer services and products, send information about the controller’s activities, including by electronic means such as email, SMS messages, etc., under Act No. 480/2004 Coll., until the withdrawal of this consent via email:
Ordering and Payment
The Buyer orders goods through the Czech ordering system of the e-shop. A purchase contract is concluded by selecting goods on the e-shop, submitting the order by the Buyer, and accepting it by the Seller. The Seller confirms this acceptance to the Buyer by an informational email to the provided email address. The resulting contract may be amended or canceled only by agreement of both parties or for legal reasons. The concluded purchase contract is not archived by the Seller and is not accessible to the Buyer upon request. The offer and price listed on the e-shop are valid for as long as the goods are offered in the online store. The Buyer bears the costs of using communication means. The final calculated price after filling in the order form is stated excluding shipping costs. The price at the time of ordering is the valid price in the contract between the Seller and the Buyer. The tax document issued based on the purchase contract also serves as the delivery note. The Buyer collects the goods after payment unless otherwise agreed. If the Buyer pays and the Seller cannot deliver the goods, the Seller will refund the payment within 30 days by an agreed method. The goods remain the property of the Seller until fully paid.
The Seller accepts payments by cash on delivery, bank transfer, or in person (by agreement). The Seller fulfills delivery by handing over the goods to the Buyer or to the carrier, at which point responsibility for the goods passes to the carrier until receipt by the Buyer. Product availability is indicated in the product details. The delivery time depends on product availability, payment terms, and delivery conditions. Usually, goods are shipped within 4 working days after full payment is received. The final delivery date is always stated in the order confirmation email. The Buyer receives a tax document or invoice with the shipment. For efficiency, the Seller reserves the right to ship goods in multiple deliveries; the Buyer bears the postage costs and must agree to this procedure in advance. The delivery time for goods paid upon receipt begins on the date of the valid contract conclusion. For other payment methods, the delivery time begins after full payment is credited to the Seller’s account. The Seller accepts delivery via PPL or another courier company.
Claims, Warranty, and Exchange
Within 14 days of purchase, we offer the possibility to exchange goods for a fee of 100 CZK, either for a different size or another product. In case of return, the Buyer pays for postage. For orders over 2000 CZK, shipping costs are covered by the Seller. The warranty period for consumer goods is 24 months unless stated otherwise on the packaging or manual. The warranty does not cover wear and tear caused by normal use. For discounted items, the warranty does not cover defects for which the lower price was agreed. For used goods, the Seller is not liable for defects corresponding to prior use or wear.
To apply for a warranty repair, a proof of purchase (receipt or invoice) must be presented. When sending goods to the Seller, they must be properly packed to prevent damage during transport. The Seller does not provide post-warranty service. If a defect occurs during the warranty period, the Buyer has the right to a free repair—by replacement of defective goods or parts—or to a reasonable discount or contract withdrawal. In case of an irreparable defect, the Buyer may demand a replacement or withdrawal. For a removable defect or after the same defect has occurred three times, the Buyer may request replacement or withdrawal. Complaints do not apply to damage caused by misuse or disregard of the instructions for use. Evidence of tampering or improper storage voids the warranty. For hygiene reasons, EU regulations prohibit returns or exchanges of underwear that may have been worn. According to EU Directive L 144/19 and Directive 97/7/EC, the right to refund or exchange within 14 days applies only to unused goods. Therefore, underwear and swimwear must be tried on over personal underwear. Used goods will not be refunded or exchanged.
Withdrawal from the Contract
A Buyer who is a consumer has the right to withdraw from the contract in accordance with Section 53(7) and (8) of Act No. 40/1964 Coll., the Civil Code, as amended. The above does not apply to Buyers who are entrepreneurs concluding the purchase contract in connection with their business activity. In the event of withdrawal, the Seller will refund the purchase price to the Buyer’s bank account, which the Buyer provides for this purpose. The Seller has the right to withdraw if the Buyer fails to pay the full purchase price. The Buyer shall enable the Seller to fulfill obligations in accordance with the Offer/Contract and provide necessary cooperation. The Buyer agrees to reimburse all costs incurred by the Seller for reminders and debt collection. In case of unclaimed or refused shipments, the Buyer agrees to pay 300 CZK to the Seller’s bank account for incurred costs, unless otherwise agreed. If payment is not received within 7 working days, the amount will be collected by the Seller’s legal representative. The Buyer acknowledges that the Seller may assign claims under the Contract to a third party. The Buyer shall promptly inform the Seller of any change in their identification data, no later than within 3 working days from the change. Both parties agree to make maximum efforts to settle all disputes amicably. The mutual obligations of the contracting parties are governed by the laws of the Czech Republic, in particular Act No. 40/1964 Coll., the Civil Code, as amended.
General Terms and Conditions become valid and effective on 1.1. 2024 and are also available on the Seller’s website. The Seller reserves the right to amend these GTC at any time. The previous version ceases to be valid and effective on the date the new version becomes effective.
